1. Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of the website located at greenfinancialservice.com and any related services (collectively, the “Services”) operated by Green Financial (“Green Financial,” “the Company,” “we,” “us,” or “our”). By accessing or using the Services, submitting an application, or otherwise engaging with us, you agree to be bound by these Terms. If you do not agree, do not use the Services.

2. Who We Are and What We Do

Green Financial provides financial and consulting services for businesses in high-risk and underserved industries, including payment processing, business funding, buy now pay later for B2B, business banking support, and related services. Green Financial also operates Canna Merchant Accounts, a division serving cannabis, hemp, CBD, and adjacent high-risk merchants.

Green Financial is not a bank, lender, or licensed financial, legal, or tax advisor unless expressly stated in a separate written agreement. Many of our Services involve connecting you with third-party payment processors, acquiring banks, lenders, and funding sources. Approval, pricing, terms, and the ultimate provision of any processing account, funding, or financial product are determined by those third parties under their own underwriting criteria and agreements, not by us.

3. Eligibility

The Services are intended for businesses and the individuals authorized to act on their behalf. By using the Services, you represent that you are at least 18 years old, that you are authorized to enter into these Terms on behalf of the business you represent, and that the business is engaged in lawful activity. The Services are not directed to consumers seeking personal, family, or household financial products.

4. No Guarantee of Approval or Results

We do not guarantee that any application will be approved, that funding or a merchant account will be issued, or that any particular rate, term, or outcome will be available to you. Any statements regarding potential approval, funding amounts, timelines, or rates are estimates only and are subject to third-party underwriting and final documentation. Past results do not guarantee future outcomes.

5. Applications and Information You Provide

To use certain Services, you may be asked to provide information about you and your business. You agree that all information you provide is accurate, current, and complete, and that you will keep it updated. You authorize us to share the information you provide with the third-party processors, banks, and funding sources necessary to evaluate and deliver the Services you request. Providing false, misleading, or fraudulent information may result in denial of Services and may be reported to the relevant parties.

6. Third-Party Services

The Services may give you access to, or facilitate agreements with, third-party providers. Your relationship with any such provider is governed by that provider’s own terms and agreements. We are not responsible for the acts, omissions, products, fees, or decisions of any third-party provider, and we make no representations or warranties regarding them. Any dispute you have with a third-party provider is between you and that provider.

7. Cannabis, Hemp, and CBD-Related Services

Certain Services, including those offered through Canna Merchant Accounts, support cannabis, hemp, CBD, and related businesses. You acknowledge that the legal status of these products varies by jurisdiction and that cannabis remains illegal under U.S. federal law. You are solely responsible for ensuring that your business, products, and use of the Services comply with all applicable federal, state, and local laws and regulations, as well as the requirements of any processor, bank, or funding source. We do not provide legal advice regarding the legality of your operations, and nothing in the Services should be relied upon as such.

8. Acceptable Use

You agree not to use the Services to engage in any unlawful, fraudulent, or abusive activity; to submit information you are not authorized to provide; to interfere with or disrupt the Services or their security; or to attempt to gain unauthorized access to any systems or accounts. We may suspend or terminate access to the Services for any violation of these Terms.

9. Intellectual Property

The Services, including all content, branding, logos, text, graphics, and design, are owned by or licensed to Green Financial and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Services without our prior written permission. Third-party names and marks referenced on the site are the property of their respective owners.

10. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. You agree to indemnify and hold harmless Green Financial and its owners, officers, employees, and agents from any claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Services, your violation of these Terms, your violation of any law, or any information you provide.

13. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles.

Any dispute arising out of or relating to these Terms or the Services will be resolved by binding arbitration administered by a recognized arbitration provider, on an individual basis. You and Green Financial waive the right to a trial by jury and the right to participate in a class, collective, or representative action. Any claim must be brought within one year after it arises. If the arbitration provision is found unenforceable, disputes will be resolved exclusively in the state or federal courts located in Los Angeles County, California.

14. Changes to These Terms

We may update these Terms from time to time. The updated version will be indicated by the “Last updated” date above and will be effective when posted. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

15. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms. Provisions that by their nature should survive termination will survive.
